The MOSOVO Department has provided the following information:
Process:
In respect of convicted sexual offenders, and upon their reintegration into the community. Certain prisoners following an individual robust risk assessment of those offenders who can be safely managed (MAPPA) will be given permission to have in thier possession one or more media devices (ie. mobile phone, laptop, computer etc.) the assigned MOSOVO officer is responsilbe for installing monitoring software onto said devices.
FOIA Request
1) Before a MOSOVO officer is permitted to install such software to a device:
What legal or administrative process must the officer comply to (i.e. notification from the offender supervisor, MAPPA, etc.)? or
Any request to install monitoring software will be considered on a case by case basis. The MOSOVO Officer will liaise with their supervisor to ensure one of the following conditions is met before installation.
If someone is subject to a legal order, then the order will tell them within how many days they have to notify the Police of their purchase/possession/use of the device (This is usually within 3 days).
Some offenders won’t have Legal Orders but may have been released on licence with a number of conditions. If there is a condition which allows the installation of monitoring software, then the Probation Service may request that monitoring software is installed.
2) Can the released ex-offender go and purchase a device and present the devices to the MOSOVO officer and request the officer install monitoring software?
Offenders who do not have a legal order or licence conditions can request the installation of monitoring software on a voluntary basis. Any request will be considered.
3) In respect of the MOSOVO officer. Will the officer hold, or be provided with information prior to an individual who is required to have monitoring software on their device(s).
The MOSOVO Officer should be in possession of all relevant information about the offender prior to completing the installation.
